These Terms and Conditions (“Terms”) govern your access to and use of the Folly Exotics website and any purchases, loyalty programs, services, subscriptions, or products offered through the website (collectively, the “Services”).

These Terms and Conditions are entered into between you and Full Spectrum Supply LLC DBA Folly Exotics (“Company,” “we,” “us,” or “our”).

By accessing or using this website, you agree to the terms outlined in this Privacy Policy and our Terms and Conditions. By accessing the website or purchasing products, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. ELIGIBILITY AND AGE REQUIREMENTS

You must be at least 21 years of age or the legal age required in your jurisdiction (whichever is higher) to access the Services or purchase products.

By using this website you represent and warrant that:

• You are of legal age
• You are legally permitted to purchase hemp-derived products
• You will not provide products to minors

We reserve the right to require age verification and may refuse service or cancel orders at our discretion.

2. HEALTH NOTICE AND FDA DISCLAIMER

Consult a physician before using any hemp-derived product. Do not use if pregnant or nursing. Do not combine with alcohol, drugs, or medications. May cause drowsiness. Do not operate vehicles or heavy machinery after use.

Products are intended for adult use only.

Statements on this website have not been evaluated by the Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease.

3. PRODUCT LEGALITY AND HEMP COMPLIANCE

Products sold through this website are derived from hemp and are intended to comply with the 2018 Farm Bill, containing no more than 0.3% Delta-9 THC on a dry weight basis at the time of testing.

Cannabinoid laws vary by jurisdiction and change frequently. Customers are responsible for confirming legality in their location before purchasing.

By purchasing from us you acknowledge:

• Hemp flower may resemble marijuana
• Law enforcement may interpret hemp differently
• Shipping hemp products carries legal risk
• The Company is not responsible for enforcement actions or legal interpretations

4. SHIPPING, RISK OF LOSS, AND SEIZURES

All purchases are made pursuant to a shipment contract.

Risk of loss transfers to the customer when the order is delivered to the carrier.

We are not responsible for:

• shipping delays
• lost or damaged shipments
• seized or confiscated packages
• carrier errors
• customs issues
• local law enforcement actions

If a shipment is seized or destroyed by a carrier or authority, refunds or replacements are not guaranteed.

5. EXOTIC REWARDS LOYALTY PROGRAM

Folly Exotics may offer a loyalty program known as “Exotic Rewards” (the “Program”).

Participation in Exotic Rewards is voluntary and subject to these Terms.

By participating in the Program, you agree that the Program is governed by these Terms and the Folly Exotics Privacy Policy.

5A. PROGRAM OVERVIEW

Exotic Rewards allows customers to earn loyalty points (“Rewards Points”) through purchases and engagement activities.

Rewards Points may be redeemed for discounts on eligible purchases.

Rewards Points have no cash value and may only be redeemed according to the rules described herein.

5B. PROGRAM MODIFICATION OR TERMINATION

The Company reserves the absolute right, at its sole discretion, to:

• modify the Exotic Rewards Program, including the Referral Program
• change earning or redemption structures
• adjust point values
• add or remove tiers or benefits
• suspend the program
• terminate the program entirely

These changes may occur at any time without prior notice.

If the Program is terminated, all accumulated Rewards Points may be forfeited and will not be redeemable.

Participants acknowledge and agree that the Company is not liable for unused or forfeited points.

6. EARNING REWARDS POINTS

Rewards Points may be earned through qualifying purchases and approved engagement activities.

Base Earning Rate

Customers earn:

10 Rewards Points per $1 spent

Points are calculated based on Net Spend, defined as the purchase subtotal after:

• discounts
• redeemed rewards points
• returns or adjustments
• shipping charges
• taxes

Points are not earned on sale items, promotional bundles, gift cards, or other excluded products unless otherwise stated.

7. POINT VALUE

Rewards Points may be redeemed according to the following conversion rate:

1,000 Rewards Points = $1 Store Credit

Points may only be redeemed during checkout and only on eligible items.

Rewards Points cannot be redeemed for cash.

8. BONUS POINT EVENTS

From time to time, the Company may offer bonus earning opportunities or promotional multipliers.

Examples include:

Bronze Tier — 2× points
Silver Tier — 4× points
Gold Tier — 6× points
Platinum Tier — 8× points

Bonus promotions may change or be discontinued at any time.

9. MEMBERSHIP TIERS

Membership tiers are based on annual customer spending.

Tier levels are reviewed every 12 months and may increase or decrease based on spending activity.

10. TIER BENEFITS

Birthday Bonuses

Bronze — 1,000 points
Silver — 1,250 points
Gold — 1,500 points
Platinum — 2,000 points

Birthday rewards may take up to 30 days to appear.

Tier Upgrade Bonuses

Silver Upgrade — 1,000 points
Gold Upgrade — 1,250 points
Platinum Upgrade — 2,000 points

11. BONUS POINT ACTIVITIES

Customers may earn additional Rewards Points through approved engagement activities including:

Create account — 500 points
Leave product review — 300 points
Add product photo — 100 points
Add product video — 200 points
Add birthday to account — 100 points

Social engagement activities may include:

Following Folly Exotics social media — 200 points
Posting about Folly Exotics — 200 points
External reviews — 200 points

The Company reserves the right to approve, reject, or modify engagement rewards.

12. REFERRAL PROGRAM

Folly Exotics may offer a referral program where Customers may earn Rewards Points for referring new customers.

Example referral structure:

Referred customer receives 20% off their first purchase.

Referrer receives 2,000 Rewards Points once the referred customer completes a qualifying purchase of at least $99.

Referral abuse may result in account suspension.

13. MINIMUM REDEMPTION REQUIREMENT

The Company may establish minimum redemption thresholds for Rewards Points.

Unless otherwise stated:

A minimum of 5,000 points must be accumulated before redemption is permitted.

Redemptions may only be applied in increments determined by the Company.

These thresholds may change at any time.

14. POINT EXPIRATION

Rewards Points expire 12 months after the date they are earned.

Expired points cannot be reinstated.

15. PROGRAM POINTS ARE PROMOTIONAL REWARDS

Rewards Points are promotional incentives only and do not constitute property, stored value, or cash equivalents.

Rewards Points:

• have no monetary value
• cannot be transferred
• cannot be sold or traded

The Company may cancel or revoke points at any time due to fraud, system error, program changes, or program termination.

16. FRAUD PREVENTION AND PROGRAM ABUSE

The Company reserves the right to review all Rewards accounts for suspected abuse.

Examples include:

• creating multiple accounts
• referral manipulation
• bot activity
• fraudulent reviews
• returning purchases after earning points

If abuse is detected, the Company may:

• revoke Rewards Points
• suspend accounts
• terminate participation in the Program

All determinations regarding abuse are final.

17. PROGRAM LIMITS

The Company may impose limits on:

• points earned per purchase
• points redeemed per order
• referral rewards
• bonus promotions
• rewards earned within a given time period

These limits may change at any time.

18. PRICING AND PRODUCT AVAILABILITY

Prices may change without notice.

We reserve the right to:

• limit quantities
• cancel orders
• correct pricing errors
• discontinue products

19. INTELLECTUAL PROPERTY

All website content including logos, product names, images, and branding are the property of Folly Exotics.

Unauthorized use is prohibited.

20. DISCLAIMER OF WARRANTIES

All products and services are provided “AS IS” without warranties of any kind.

21. LIMITATION OF LIABILITY

To the fullest extent permitted by law, the Company shall not be liable for indirect or consequential damages.

Maximum liability shall not exceed:

$100 or the amount paid for the product giving rise to the claim, whichever is less.

22. INDEMNIFICATION

You agree to indemnify and hold harmless the Company and its affiliates from claims arising from use of the Services.

23. DISPUTE RESOLUTION

All disputes shall be resolved through binding arbitration administered by the American Arbitration Association.

Participants waive class actions and jury trials.

24. GOVERNING LAW

These Terms are governed by the laws of the State of South Carolina.

25. FORCE MAJEURE

The Company is not responsible for delays caused by events beyond its control including natural disasters, regulatory changes, or shipping disruptions.

26. CHANGES TO TERMS

These Terms may be updated from time to time and will be reflected on this page.

Continued use of the Services constitutes acceptance of the updated Terms.
